Title IX of the Education Amendments of 1972 (Title IX), 20 U.S.C. 1681

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

On 1 December 2014, U.S. Department of Education’s Office of Civil Rights published a clarification of requirements for offering single-sex classes in K-12 schools. It is written in Q&A form and thus easily accessible. The clarification in short:

  • single-sex classes have to be completely voluntary
  • the school must identify an important objective for offering a single-sex class and show that the single-sex nature of the class is substantially related to meeting the identified objective.
  • the school must offer a substantially equal coeducational alternative.
  • the school “must not assign teachers to single-sex classes on the basis that boys should be taught by men and girls should be taught by women or vice versa.”
  • periodic evaluations (at least every 2 years) are demanded by Title IX “to ensure that each single-sex class it offers is based upon genuine justifications, does not rely on overly broad generalizations about either sex, and continues to be substantially related to the achievement of the important objective”.
